The alleged thief quickly got into the back seat of a small grey car whose license plate the neighbor noted. Shortly afterward a police lieutenant saw the car heading east on Brookside Drive. He stopped the car at Samp Mortar Drive and pulled him over. Homa was driving and Marchionni was in the back seat. There was no leaf blower. Nancy Teresa Kane, 49, of Fairfield, was charged with criminal trespass in the first degree, criminal mischief in the third degree, disorderly conduct, and interfering with an emergency call.

He refused to admit her and the next thing he knew he heard glass breaking in the basement and she was coming up the basement steps. He later found a broken basement window through which she had gained entry to the house. The two had a verbal argument. When her ex-husband tried to call police, she grabbed his cell phone and then ripped the other phone out of the wall. She later admitted to having done so. Police observed fresh scratches on the ex-husband's neck and when police went to her house to question her, they observed a fresh bandage around her wrist. Police released her on $100 bond and ordered her not to have further contact with him until after she went to court that morning.
