Dan Patrick's proposed THC ban triggers Texas GOP clash over cannabis

Texas Ag Commissioner Sid Miller this week said it's time for Republicans to "support the will of the people of Texas" when it comes to cannabis policy.

Miller voiced his opinion after Lt. Gov. Dan Patrick announced Wednesday that banning THC products would be a top priority in the state legislature next year, and the two Republican-elected Texas officials don't seem to be on the same page.

Currently, Texas cannabis laws are defined by two key pieces of legislation -- House Bill 1325 and the Texas Compassionate Use Act. The former authorizes the sale of consumable hemp products that do not exceed 0.3% delta-9 THC by "dry weight" standards. The latter allows physicians to prescribe "low-THC cannabis" to patients with conditions like cancer, epilepsy, PTSD and more.

While HB 1325 provides several loopholes for retailers to legally sell certain types of cannabis and cannabis-based products for both psychoactive and therapeutic effects, Patrick issued a statement Wednesday announcing his intent to close those loopholes altogether.

"Senate Bill 3 will ban all forms of THC and keep these unsafe products off our streets," Patrick said. "We are not going to allow these retailers to circumvent the law and put Texans' lives in danger."

While Patrick later stated that the Texas Compassionate Use Act would not be affected by his proposed ban, many Texans have expressed concern over access.

"Sir, why is the Texas government trying to outlaw THC?" X-user @Sethersk82 asked Miller in a Thursday post. "Isn't it medicine for some folks?"

"Not everyone is on the same page on this," Miller responded. "The GOP needs to find some consensus instead of constantly running in opposite directions. We know what the polls say. It's time to support the will of the people of Texas."

While Miller has not expressed support for recreational marijuana use, he did advocate for the expansion of Texas' Compassionate Use Program in July 2022.

"I believe that cannabis prohibition came from a place of fear, not from medical science or the analysis of social harm," Miller wrote in his editorial. "Sadly, the roots of this came from a history of racism, classism, and a large central government with an authoritarian desire to control others.

"We owe it to our fellow Texans, especially those who are suffering, to lead or just get out of the way if we cannot formulate effective cannabis policy for Texas."
