Halifax judge gives cocaine trafficker break at sentencing for turning life around

A former Halifax man who sold cocaine to undercover police officers has avoided prison time on trafficking charges.

Jason Andrew Saldanha, 24, of Mississauga, Ont., pleaded guilty in Nova Scotia Supreme Court in Halifax in December to charges of trafficking and possession for the purpose of trafficking.

Justice Glen McDougall went outside the normal sentencing range and imposed a suspended sentence with three years' probation.

The written version of McDougall's June 5 decision was released Thursday.

"Given the exceptional circumstances of this case, I believe that the most appropriate resolution would not involve incarceration," the judge said.

McDougall said Saldanha, a first-time offender, "turned things around" after his arrest in September 2015 and went on to demonstrate leadership skills in his engineering studies at Dalhousie University and, subsequently, in his professional career.

"If given the opportunity, I know you will not deviate from the path you are now on -- the one that you were previously on save for the few short months when you veered off course in a misguided effort to become a part of the so-called in-crowd," the judge said.

"I believe you have learned from that mistake."

The court heard that Saldanha sold a dime bag of cocaine to an undercover officer in May 2015 and agreed to sell two dime bags to another undercover officer the following September.

Police followed the second undercover officer to the lobby of Saldanha's apartment building on Barrington Street, where the deal was to be completed, and made the arrest.

Saldanha was found to be carrying two dime bags and two cellphones. A search of his bedroom turned up nine more bags of cocaine.

The total weight of the drugs seized that night was 6.1 grams.

"Mr. Saldanha was more of a delivery person than a trafficker," McDougall said. "He appears to have been catering more to his own personal consumption habit than an active supplier motivated by profit. (He) had only been introduced to the party scene a brief few months before he was charged."

The judge said involvement in the drug culture "nearly always spells disaster. Clearly, you have avoided that outcome."

He urged Saldanha to "keep doing what you are doing."

"If you look back from time to time, do not dwell on the mistake that has brought you before me today," McDougall said. "I am not suggesting you should ignore it or forget about it. You should learn from it and resolve never to do something like that ever again.

"You have done many more good things in your life, many more good things than bad. We all make mistakes; it is an inevitable consequence of living one's life. The challenge is in learning from those mistakes and trying harder to do better."

Saldanha cannot consume or possess alcohol or drugs while he's on probation and must observe a 10 p.m.-6 a.m. curfew for the first year.

The judge directed him to perform 40 hours of community service.

"I would hope that some of that (involves) speaking with students about the perils of getting involved with drugs and urging anyone who may have an inclination or a desire to experiment with drugs to perhaps refrain from doing so," McDougall said.

Saldanha was also ordered to provide a DNA sample for a national databank and prohibited from having weapons for 10 years.
