Floore's, Mix co-owner's mother sues over his death after he ingested fentanyl-laced cocaine
San Antonio's 502 Bar and two individuals have been sued for negligence in the death of Blayne Tucker.
By Patrick Danner, Staff writerNov 27, 2024
Blayne Tucker was the co-owner of The Mix and Floore's Country Store. He died Dec. 30, 2022, after ingesting fentanyl-laced cocaine. He was 42. His mother has now filed a negligence lawsuit over his death. Tucker is shown speaking at the National Independent Venue Association in 2022 in Cleveland.
Attorney Glenn Deadman, shown in 2023, is listed in state corporate records as an owner of Ubar None LLC. It does business as 502 Bar. The business has been sued for negligence by the mother of the late club owner Blayne Tucker. Deadman is not a defendant in the lawsuit.William Luther
The mother of late club owner Blayne Tucker is suing a San Antonio bar and two individuals for negligence, alleging they played a role in Tucker's 2022 death after he ingested fentanyl-laced cocaine.
Camille Gray, as representative of Tucker's estate, is seeking more than $250,000 in damages from Ubar None LLC, which does business as 502 Bar, as well as Deric Wynne, who's listed in state corporate records as the establishment's co-owner, and San Antonio resident Katherine S. Kohler.
Wynne, who describes himself on his LinkedIn page as 502 Bar's production director, and Kohler couldn't be reached for comment.

The bar's other co-owner is San Antonio lawyer Glenn Deadman, who is not a defendant.
"The incident was investigated by SAPD and they found no wrongdoing," Deadman said in email Wednesday. After receiving a copy of the complaint from the San Antonio Express-News, he said, "I'll reserve comment until I get some facts."
Tucker was a widely respected advocate of San Antonio's live music scene and co-owned the Mix, a bar on the St. Mary's Strip, and Helotes honky tonk Floore's Country Store.
On the night of Dec. 29, 2022, his mother's lawsuit says, Tucker met Wynne at 502 Bar on the North Side.

"Upon information and belief, while at the 502 Bar, Wynne provided illicit drugs, namely cocaine, to Tucker," the suit says, adding that a medical examiner's toxicology report revealed the cocaine was laced with fentanyl. Fentanyl is a potent opioid significantly more powerful than morphine.
The pair traveled to Wynne's residence in the 200 block of Schmeltzer Lane after leaving the bar about 1:30 a.m. on Dec. 30, the suit says. The property is co-owned by Kohler, who was at home.
While in the kitchen, Tucker collapsed.
"Based on information and belief, neither Wynne nor Kohler administered life saving measures," the suit says. One or both waited "critical minutes or hours before calling 911."
When EMS arrived, Wynne and/or Kohler "falsely reported to EMS they smoked marijuana with Tucker, but this was not true." The toxicology report showed that he tested negative for cannabis.

Wynne, Kohler or both told law enforcement and emergency medical personnel that Tucker had eaten popcorn and mashed potatoes at the house, the suit says. Neither was found in his stomach.
Emergency personnel attempted to save Tucker's life by administering Narcan, a medication to reverse an opioid overdose, "but it was too late." Tucker died Dec. 30, 2022. He was 42.
"Had Wynne and/or Kohler been forthright with responding EMS personnel, EMS could have timely administered the Narcan and Blayne Tucker might be alive today," the suit says. Wynne, 43, and Kohler, 32, have no criminal history.
The suit also says Tucker "would be alive today" if 502 Bar had trained its staff on "policies and procedures related to consuming illegal drugs."
The bar knew or should have known "the activities ongoing within its premises," the lawsuit adds. It "failed to act or prohibit those actions and allowed individuals to continue partaking in and consuming illegal drugs."

Gray, Tucker's mother, lives in Caldwell County. She filed the suit Friday in state District Court in San Antonio. Jeremy Sloan, a San Antonio lawyer who represents her, declined to comment.
Besides having ownership in the Mix and Floore's, Tucker formed the St. Mary's Business Owners Association as a way to give live-music entrepreneurs on the Strip a platform fort their concerns.
In April 2020, as COVID-19 wreaked havoc on the live-music industry, he joined a group of his colleagues across the country in forming the National Independent Venue Association to seek federal help. He played a pivotal role in getting federal legislation passed that provided a $15 billion lifeline to the country's independent music venues.
Tucker also co-founded the Maverick Music Festival. He used his skills as a lawyer to sue Madonna's dormant record label, Maverick Records, for the right to use the name.
